Terms of Service

These terms apply to Rascal UGC (“Rascal”, “we”), reachable at rascalugc.com. By creating an account or using the software you agree to them. If you do not, do not use the service.

1. What the service is

Rascal is a studio for producing short-form video with AI avatars. It orchestrates model providers on your behalf; it does not generate video itself. Frame generation, motion control and template import run against provider accounts that belong to you, under those providers’ own terms and at their own rates. We are not a party to that relationship and take no share of what you spend with them.

2. Your account

You are responsible for keeping your credentials secure and for everything done under your account. You must be at least 18, and you must not share a seat with someone who is not named on it. We may suspend an account that is being used to break these terms or the law, and will tell you why when we do.

3. Content you bring

You keep ownership of everything you upload: reference videos, avatar images, and the outputs produced from them. You grant us only the licence needed to run the service — to store, process and transmit that content so the pipeline can do its job — and that licence ends when you delete the content or close the account.

You confirm that, for everything you upload, you have the right to use it. Specifically:

• You have the rights or permissions needed for any reference video you import, and for the likeness of any person appearing in an avatar image.
• You have written consent from any identifiable person whose face you use to create an avatar, and you can produce it if asked.
• You will not use the service to depict a real person saying or doing something they did not, in a way intended to deceive; to produce sexual content involving anyone who is or appears to be a minor; or to harass, defame or impersonate anyone.

We do not pre-screen content. We will remove content and terminate accounts that breach this section when we become aware of them.

4. Acceptable use

Do not attempt to gain unauthorised access to the service or to another account, probe or load-test it without written permission, resell access to it, or use it to build a competing product from data you obtained through it.

5. Plans, payment and cancellation

Paid plans are billed monthly in advance in euros through our payment processor. Prices exclude VAT, which is added where applicable. You may cancel at any time; the plan then runs to the end of the period you have already paid for and does not renew. We do not refund part-used periods except where the law requires it. If we change a price we will give you at least 30 days’ notice before it applies to your renewal.

Your library remains readable and exportable for 30 days after a plan ends, after which it may be deleted.

6. Availability

The service is provided as it is, without any warranty. We do not promise a level of uptime, and we depend on third-party providers whose outages we cannot control. We will not be liable for indirect or consequential loss, or for lost profits or data. Where liability cannot be excluded, it is capped at what you paid us in the twelve months before the claim arose. Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.

7. Changes

We may update these terms. Material changes will be announced by email or in the application at least 30 days before they take effect, and continuing to use the service after that date means you accept them.

8. Law and contact

These terms are governed by Belgian law, and the courts of Belgium have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protections of the law of your own country of residence.
